In accordance with the Digital Millennium Copyright Act (DMCA), Title 17, United States Code, Section 512(c), we have established this formal protocol for handling claims of copyright infringement. As a digital service provider, we qualify for “Safe Harbor” protection under the DMCA by maintaining a structured mechanism to receive and process legitimate takedown notices.
How to File a Copyright Infringement Notification
If you are a copyright owner (or an authorized agent representing an owner) and you believe that any material, parcel map layout, image, or content hosted on California Property Hub infringes upon your copyright, you may submit a formal written notification to our Designated Copyright Agent.
To be legally effective under 17 U.S.C. ยง 512(c)(3), your DMCA Takedown Notice must include the following specific elements:
- A Physical or Electronic Signature: The signature of the copyright owner or a person authorized to act on behalf of the owner of the exclusive right that is allegedly infringed.
- Identification of the Infringed Work: A clear description of the copyrighted work that you claim has been infringed (e.g., specific text, geographic data structures, or custom images).
- Identification of the Infringing Material: The exact URL or specific location on our website where the infringing material is located, so our technical team can locate and disable it.
- Contact Information: Your full name, mailing address, telephone number, and an active email address.
- Good Faith Statement: A statement that you have a good faith belief that the use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
- Accuracy Statement: A statement that the information in the notification is accurate, and under penalty of perjury, that you are authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.

Note: Email communication is highly preferred for expedited processing and immediate technical removal.
Counter-Notification Process (For Site Users)
If your content or material was removed or disabled as a result of a DMCA takedown notice, and you believe this occurred due to a mistake or misidentification, you have the right to file a formal Counter-Notification with our agent.
Your written Counter-Notification must include:
- Your physical or electronic signature.
- Identification of the material that was removed and its location before removal.
- A statement under penalty of perjury that you have a good faith belief that the material was removed as a result of mistake or misidentification.
- Your name, address, and telephone number, along with a statement consenting to the jurisdiction of the Federal District Court for the judicial district in which your address is located (or California, if outside the US).
Upon receiving a valid counter-notice, we are legally required to forward it to the original complaining party. If they do not file a lawsuit within 10 to 14 business hours, we may restore the disabled material at our discretion.
Repeat Infringer Policy
California Property Hub takes intellectual property protection seriously. In compliance with federal mandates, we maintain a strict policy to terminate access or block IP addresses of any user, automated scraper, or contributor who is determined to be a repeat infringer of third-party copyrights.
